Delivery Terms

These Terms and Conditions are to be read and agreed to in conjunction with all other Terms and Conditions and Policies and Guidelines on the iPools.co.za site. Your continued use of the site is your acceptance of these and all other Terms and Conditions on the site.

DEFINITIONS

“Goods”means any documents, parcels or freight ordered by our customers on theiPools.co.za site and sent by our carriers to the customer’s nominated address;

“Carriage” or “Shippings”  or “Shipment” means the transport of goods from one point to another by the carrier nominated by iPools.co.za or the customer;

“Carrier”means the company nominated by iPools.co.za or the customer to deliver goods purchased from iPools.co.za to the customer’s nominated address, including such company’s staff, agents and/or sub-contractors;

“Customer”means the party responsible for the payment of the goods and carriage;

“Owner” means the party who has a financial interest in the goods;

.“Parties”means the client, owner, the sender, the receiver and/or the carrier;

“Waybill” is the accompanying document which identifies the customer, the number and weight of packages involved and instructions regarding the time and place of both the collection and delivery, copies of which are signed by the parties and serves as proof of handover of the goods from one party to the other.

IPOOLS PREFERS THESE BASIC METHODS OF SHIPPING:
  • Courier Services – we will quote on the shipping costs. Prices depend on dimensions, weight and whether you stay in any of the main centres of the Republic of South Africa or in a rural area.
  • Collect – you are welcome to collect your purchase from our store, or any stores that may be nominated from time to time, to save on delivery charges
  • Own Courier – Select our “I will send my own courier” option with clear instruction and use your own courier to collect

Most of our shippings are collected by courier companies 1 (one) working day after check-out of the cart and delivered within 2 (two) to 5 (five) working days at your doorstep. Couriers do not take responsibilities for deliveries to the Post Office.  Please use an address where you or a representative will be available to receive the shipment during working hours Monday to Friday (excluding public holidays).  Should you give an address where no-one is available to receive the goods and redelivery needs to take place, you will be responsible for redelivery fees.

WHERE WE DELIVER TO AND RESTRICTIONS THEREOF

The delivery service is available to most areas in the Republic of South Africa. From time to time, and with no prior warning, we will update the delivery coverage areas. Whilst we endeavour to expand our coverage, we reserve the right to restrict deliveries in certain areas, including areas previously covered by our service.

The Website will also reflect the availability of a delivery to take place on a future date nominated by you.  Please remember that the day you select is the day it will be collected by the delivery service at our premises and thus delivery to your doorstep will only take place 2 (two) to 5 (five) working days after your nominated date. The deliveries are booked on a first come, first served basis. Upon reaching the delivery capacity, a slot will be marked as unavailable and you will not be able to book a delivery for that particular slot.

 We also reserve the right to withdraw our services to individual customers’ addresses subject, but not limited, to the following:

  • Dangerous delivery conditions that pose a health and safety risk for our carrier’s drivers and/or any assistant;
  • Unavailability of free suitable, and legal, parking and offloading space;
  • Excessive distance between the vehicle offload point and the final customer handover point, including any unreasonable requirement or expectation to climb stairs or negotiate other physical obstacles;
  • Repeated unavailability of an authorised signatory to take delivery;
  • Repeat and excessive returns that misuse the reasonable nature of the service;
  • Repeat and/or excessive short supply or damage claims for which responsibility or liability cannot be determined.

 

Should we not deliver to your area and you would like us to – please submit your location to us by email at sales@ipools.co.za and we will contact you when/if we are able to extend coverage to your area.

We cannot accept responsibility for the provision of an incorrect delivery address. We will deliver to the address provided at point of order submission. This delivery address is clearly displayed throughout the online shopping experience and can easily be changed at any point up until final payment confirmation. Should we be unable to deliver due to the provision of an incorrect delivery address, we will contact you to obtain the correct delivery address and you will be responsible for all redelivery fees.

THE DELIVERY PROCESS, INCLUDING WHERE YOU CANNOT BE PRESENT

Delivery times offered will vary according to the requirements of the delivery service.

The driver will bring the shopping to the door of your premises or business only, where you will be asked to check your goods, note any returns on the invoice and sign the invoice to accept the delivery.

Only at your express invitation and risk, can the driver be requested to take your shopping into an area within your premises (or an appropriate designated area for a business) where your goods are stored or accepted. Providing entry into your premises is at your own risk. iPools.co.za accepts no liability or responsibility for any loss or damages occurring as a result of or consequence of your request for the driver entering your premises, whether or not the loss or damages could be construed to be as a result of negligent behaviour.

Drivers will carry identification which you must ask for. Drivers will be able to inform you of the order number and the intended recipient (as provided on the order) as an additional security check.

Goods must be signed for at the delivery address, by you, or by a nominated representative who must be aged 18 (eighteen) years or above. Under no circumstances will goods be left unattended, for example in a garage, or with anybody below the age of 18 (eighteen) years.

It is your responsibility to be present (or make sure an authorised signatory is present) for receipt of the delivery. If, in the event that no authorised signatory is available to accept and sign for your delivery order, our driver will wait a total period of 10 (ten) minutes for an authorised signatory to present themselves prior to leaving and returning your order to us. A delivery card will be left by our driver detailing the time of their arrival and departure and the start and end time of the chosen delivery slot. You will be asked to contact the Customer Service Centre at your earliest convenience to arrange an alternative delivery time. You will be liable for a re-delivery fee equal to the current delivery price of the order agreed upon for re-delivery.

If you do not contact us to rearrange a failed delivery within 12 (twelve) hours of the failure of the original delivery, the order will be cancelled and the cost of your order (excluding the cost of delivery charges together with the cost of returning the shipment to us) will be refunded to you in the form of a store credit. For the avoidance of doubt, iPools.co.za reserves the right to retain the cost of the associated delivery charge and return carriage to us when the service has been provided in accordance with the Terms and Conditions as laid out.

For  delivery, your order will be presented in sealed envelopes or boxes – with exceptions for loose items unable to fit, or bulk products which are more easily transported and delivered in their original packaging. The seals should only be broken in the presence of an authorised signatory. Should the packages not be sealed, or the seals already broken, you should not accept the order and immediately contact our Customer Service Centre on sales@ipools.co.za.

Please note adverse weather conditions, accidents, road work, unusual traffic congestion, war, civil disobedience, industrial dispute, act of God, or any event beyond our or our carrier’s reasonable control, may result in the occasional late or cancelled delivery. If that is the case we will endeavour to contact you as soon as we are able to and reschedule your delivery time and date. In any event, for cancelled deliveries our liability to you will be limited to refunding the price of any goods not delivered and the associated delivery charge. We cannot be held liable for delivery delays outside of our control and any refund where liability is accepted will be limited to the cost of the delivery charge.

Deliveries are limited to 1 delivery per address per day.

UNPACKING OF BOXES AND THE CHECKING OF ORDERS

Due to the physical nature of a delivery, the drivers will be limited, when making deliveries that require ascending or descending stairs, to a single story only. Deliveries greater than a single story will require the provision of a lift or escalator located within a reasonable distance of the final delivery point.

The driver will unpack your delivery onto a flat open surface only – either at the door of your premises or business, or in an appropriate designated area of a business at your express request. For the avoidance of doubt, this will not include unpacking into cupboards or onto shelves.

It is your responsibility to check the invoice against the delivered goods in a timely manner and not to unduly delay the driver in the process.

DELIVERY AND COLLECTION CHARGES

Delivery charges are determined locally based on the factors affecting deliveries at your chosen delivery address and from the store. iPools.co.za reserves the right to adjust delivery charges, at any time and without prior notification, to take into account local conditions and quality of service in accordance with every delivery address.

In store collection (where available) is currently free, although iPools.co.za reserves the right to apply a reasonable charge without prior notification.  Please allow 1 (one) working day after check-out of your cart for packing of the order.

Orders are currently not subject to a minimum order value – iPools.co.za reserves the right to amend this policy at any time and apply a minimum order value without prior notification.

ORDERS FOR COLLECTION AT OUR PREMISES AND RESTRICTIONS THEREOF

In store collection for orders placed through our Website is available. These collections may be made by your driver or you may send your own courier company.  Please allow 1 (one) working day after check-out of your cart for packing.

Goods must be signed for upon collection, by yourself, or by a nominated representative who must be aged 18 (eighteen) years or above. Under no circumstances will goods be left unattended or with anybody below the age of 18 (eighteen) years.

You, your driver or representative, are required to present your order number to us when you collect. You, your driver or representative are required to sign the invoice and note any returns on the invoice.

As with deliveries, you are entitled to return any unwanted items for a full refund in accordance with our Terms and Conditions of Returns and Refunds. For the avoidance of doubt, this is a separate Online Shopping process to returning goods directly to the collection store.

If you fail to collect your order within 7 (seven) days of check-out of the cart, the store will inform the Customer Service Centre, who will contact you to arrange an alternative collection time. iPools.co.za reserves the right to charge a reasonable re-stocking fee should you fail to collect your order and request a refund.

DELIVERIES ON ORDERS ABOVE R10,000.00 IN VALUE

For orders above R10,000.00 (ten thousand Rand) in value, we cannot guarantee meeting your specific selected delivery slot due to the size of the order. Should we be unable to meet your chosen delivery slot, we will be in contact to arrange an alternative delivery time and/or day. We reserve the right to adjust this order value threshold at any time and without prior notification.

Please note that orders above R10,000.00 (ten thousand Rand) in value require a lead time to prepare prior to delivery – we will endeavour to contact you as soon as possible during this period should we need to adjust your delivery slot.

GOODS CHARGED FOR BUT NOT SUPPLIED

In the event of there being an item missing from an order but included on the invoice, this should immediately be brought to the attention of the delivery driver, agreed upon as such, and noted on the signed invoice (to be returned with the driver). You will have the option of a full refund or delivery at no charge of the noted item(s) on receipt of the signed invoice. Failure to notify of any shortages of products at this point will designate full acceptance of the delivery in accordance with the signed invoice. This does not affect your statutory rights with respect to the products purchased.

DAMAGED GOODS OR DELIVERY ORDER ERRORS

In the event of there being damaged goods, quality concerns or a difference with respect to the invoice and items delivered, these should immediately be brought to the attention of the delivery driver and noted as such on the signed invoice. Goods marked on the invoice for return, whether for damages or other reasons, must be given back to the driver and will be returned for a full refund. Failure to notify the driver of errors, or of unacceptable condition of any products, at this point will designate full acceptance of the delivery in accordance with the signed invoice. This does not affect your statutory rights with respect to the products purchased.

Please note that iPools.co.za will not, and is under no obligation to, offer any redelivery as result of damaged items, quality concerns or errors. iPools.co.za‘s obligation will be to remedy the situation through a refund in the form of a store credit when the item(s) is/are returned with the delivery driver.

DELIVERY DAYS

Delivery will only take place between the hours of 08h00 and 16h00 on working week days.

There are NO deliveries on Saturdays, Sundays and Public Holidays.

Deliveries are collected 1(one) working day after check-out of the cart and effected 2 (two) to 5 (five) working days following collection from iPools.co.za, unless you have chosen to accept delivery at a later date.

We only deliver to registered customers within certain specified delivery areas. On delivery of the order to the specified delivery address, you will receive a waybill, our delivery note showing the items delivered, any non-available items, the delivery fees, Value-Added Tax and the amount debited from your payment card. For verification purposes, the person accepting delivery at the delivery address may be required to produce a form of identification. Any person other than yourself who receives the products at the delivery address is presumed to be authorised to accept delivery on your behalf. Should no-one be in attendance at the time of delivery, the driver will keep the products and leave a notice at the delivery address to this effect. The driver will attempt to contact you to make new arrangements for delivery or collection. We reserve the right to charge an additional delivery fee should it be required in the circumstances. Our liability for failing to deliver the products timeously is limited to delivery being effected at a later agreed time at no additional charge. Please arrange that you or your authorised representative is available to accept your purchases at the delivery address and that appropriate access will be made available. On delivery, we will require you or your authorised representative to sign and print your or their name on a duplicate copy of the delivery note or waybill, to confirm receipt. We have outsourced all delivery arrangements. Accordingly, we cannot, to the extent permitted by law, be liable for any damage suffered or loss incurred by reason of any acts or omissions of the carrier, its directors, employees, sub-contractors, agents, representatives and/or affiliates.
